Pensions law in Scotland is constantly evolving though recent case law as well as government legislation. A key act solicitors look at when considering pensions law is the Pensions Schemes Act 1993 (PSA 1993). This deals with many aspects of occupational pensions, personal pensions, pension schemes and rights to state pensions.

Another key piece of legislation is the Pensions Act 1995 (PA 1995) which also introduced significant changes. Prior to this act, a pension scheme member who was divorcing his spouse could be forced by a court to pay a bigger share of their matrimonial property compared to a situation where where no pension rights existed.

Divorce, Dundee

In Dundee, subject to the laws of Scotland, the grounds for divorce are 'irretrievable breakdown' of your marriage. There law allows for four reasons why this could happen:

  • adultery
  • unreasonable behaviour
  • non-cohabitation for a period of two years
  • non-cohabitation for a period of one year with the consent of the other party

If there are no children in the marriage and no financial claims are made by either party in the relationship, and of the four reasons, the ground for divorce is non-cohabitation then a so called 'quickie divorce' can be obtained.

However, if there are children involved in the relationship and/or there is some debate as to financial issues, such as what will happen to the house, savings, car, maintenance etc, then divorce cannot be granted without resolution from the courts. In this case you will have to go through a lawyer.
